Welcome to Silkbinary. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User", "you"), and Plak India, doing business as Silkbinary ("Silkbinary", "we", "us", or "our"), registered in Guwahati, India (GST: 18LGPPK3811D1Z7), concerning your access to and use of the Silkbinary.com website as well as any related products, services, or software (collectively, the "Services").
1. Definitions
To ensure clarity, the following terms are strictly defined within the context of this agreement:
- "Service" or "Services": Encompasses all offerings by Silkbinary, including but not limited to web hosting, web design, Software as a Service (SaaS), Virtual Private Servers (VPS), Dedicated Servers, custom software development, and associated hardware/software maintenance.
- "User", "You", "Customer": Any individual, entity, or automated system accessing or utilizing our Services.
- "Account": The secure digital identity created by a User on Silkbinary.com to access and manage Services.
- "Third-Party Services": External platforms, APIs, or software integrated into Silkbinary's infrastructure (e.g., CPanel, DirectAdmin, AWS, Cloudflare, Google, GitHub, Apple, Facebook).
2. Acceptance of Terms
By registering an Account, purchasing a Service, or simply browsing Silkbinary.com, you expressly agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and Refund Policy. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.
3. User Accounts and Authentication
3.1 Account Creation
Users must provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials.
3.2 Third-Party Authentication
Silkbinary allows Users to authenticate, log in, or sign up utilizing Third-Party Services (including but not limited to Google, Apple, GitHub, and Facebook). By utilizing these authentication methods:
- You agree that your authentication is subject to the respective End User License Agreements (EULAs) and Privacy Policies of those Third-Party Services.
- We are not responsible for any security breaches, downtimes, or account lockouts originating from the Third-Party authentication provider.
4. Services, Payments, and Billing
4.1 Scope of Services
Silkbinary reserves the right to modify, suspend, or discontinue any Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
4.2 Payment Terms
Payments for Services are accepted in United States Dollars (USD) via PayPal and Indian Rupees (INR) via PhonePe (supporting UPI, Credit/Debit cards). Silkbinary explicitly does not collect or levy any currency conversion fees; any such fees are strictly between you and your financial institution or the respective payment gateway.
5. Allowed and Disallowed Uses
5.1 Allowed Uses
You may use the Services only for lawful purposes and in accordance with these Terms. Services are intended for hosting legitimate websites, running authorized software, and standard business/personal web operations.
5.2 Prohibited Activities (Strictly Enforced)
You agree NOT to use the Services for any of the following activities. Violation will result in immediate Account termination without refund:
- Malicious Activities: Distributing malware, viruses, trojans, or executing Denial of Service (DoS/DDoS) attacks.
- Resource Abuse: Utilizing VPS or Dedicated Servers for cryptocurrency mining, network scanning (e.g., Nmap), or sustained 100% CPU usage negatively impacting shared nodes.
- Illegal Content: Hosting child exploitation material, unconsented adult content, or content promoting terrorism or illegal narcotics.
- Spam: Sending unsolicited bulk email (SPAM), operating open mail relays, or hosting phishing sites.
Hypothetical Scenario: Service Misuse
If a User purchases a VPS and utilizes it to run automated vulnerability scanners against third-party networks without authorization, Silkbinary systems will flag the anomalous outbound traffic. Upon verification, the User's VPS will be immediately suspended, their account terminated, and all associated data permanently deleted. No refund will be issued per Section 5.2.
6. Third-Party Integrations and Liability
Our infrastructure heavily relies on integrations with CPanel, DirectAdmin, AWS, Cloudflare, and others. Your use of our Services implies acceptance of their respective upstream terms. Silkbinary provides no warranty regarding the uptime, functionality, or data integrity of these Third-Party Services. Any disruptions caused by upstream providers are considered Force Majeure.
7. Intellectual Property
For custom software development and web design services, intellectual property rights remain with Silkbinary until full payment is received and deployed. Once deployed, usage rights are transferred to the Customer as per the specific custom service contract, though Silkbinary retains rights to any underlying frameworks or proprietary libraries used.
8. Limitation of Liability and Indemnification
IN NO EVENT SHALL SILKBINARY, PLAK INDIA, OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Services or breach of these Terms.

Silkbinary, operated by Plak India, is committed to protecting your privacy. This Privacy Policy outlines what data we collect, why we collect it, how it is stored, and your rights regarding your personal information.
1. Data Collection and Usage
We believe in data minimization. We only collect information strictly necessary to provide, manage, and bill for our Services.
1.1 Information You Provide to Us
- Account Information: Name, email address, physical address (for billing), and phone number.
- Support Data: Information you submit when opening a support ticket or contacting our team.
1.2 Information Collected Automatically
- Service Usage Data: Server IP addresses, bandwidth logs, and resource utilization metrics (CPU/RAM) necessary for billing and maintaining infrastructure integrity.
1.3 Third-Party Authentication Data
When you use Google, GitHub, Apple, or Facebook to authenticate, we receive only the basic profile information permitted by those platforms (typically your name, email address, and a unique platform ID). We do not receive or store your passwords for these third-party services.

3. Data Sharing and Sub-processors
Silkbinary does not sell, rent, or trade your personal information. We only share necessary data with trusted service providers (sub-processors) to facilitate our Services:
- Payment Processors: PayPal (USD) and PhonePe (INR) process your financial data securely. We do not store raw credit card numbers on our servers.
- Infrastructure Partners: If you purchase AWS or Cloudflare integrated services, basic routing/account configuration data is shared with them to provision the service.
4. Data Storage and Security
Your data is stored securely on encrypted databases. We employ industry-standard security measures, including SSL/TLS encryption for transit and restricted access controls for data at rest. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure.
5. User Rights (GDPR & CCPA Style Compliance)
Regardless of your global location, Silkbinary extends robust data rights to all Users:
- Right to Access: You may request a copy of the personal data we hold about you.
- Right to Rectification: You can update inaccurate data via your client portal.
- Right to Erasure ("Right to be Forgotten"): You may request the deletion of your account and personal data, provided there are no pending invoices or legal requirements (e.g., tax records) mandating retention.
Scenario: Data Deletion Request
A User cancels their hosting service and requests full data deletion. Silkbinary will immediately securely wipe the hosted data from the server. User profile data will be deleted from active databases. However, basic transaction invoices containing the User's name and amount paid will be securely archived for 7 years to comply with Indian GST tax laws (18LGPPK3811D1Z7).

Purpose: To identify you as a logged-in user and grant you access to your client area, billing portal, and server management dashboards.
Duration: Session (expires when you close your browser) or up to 30 days if you select "Remember Me".
2.2 Security and Service Cookies
We may use cookies to prevent fraudulent activity, mitigate DDoS attacks, and ensure the basic routing of your connection to the correct server cluster.
Purpose: Essential security and load balancing.
Duration: Typically less than 24 hours.
3. Cookies We DO NOT Use
For absolute clarity, Silkbinary does not use:
- Analytical Cookies: We do not use Google Analytics or similar trackers to monitor your browsing behavior across our site.
- Marketing/Targeting Cookies: We do not use pixels or cookies to serve you advertisements across the internet.
- Third-Party Tracking: Our third-party auth providers (e.g., Facebook, Apple) are restricted to using cookies solely for the authentication handshake on our domain.
4. Managing Your Cookies
Because the cookies we use are strictly necessary for the service to function, you cannot opt-out of them while using our authenticated services. If you configure your browser to block all cookies, you will be unable to log in to the Silkbinary client portal or manage your services.
Refund Policy

At Silkbinary, we allocate significant computational resources, software licenses, and human labor immediately upon order processing. Therefore, we maintain a strict, precise, and uncompromising refund policy.
1. Core Refund Rule
There are strictly NO refunds upon customer request once a service has started, is being worked on, or has been deployed.
2. Policy Application Across Services
2.1 Hosting, VPS, and Dedicated Servers
Server provisioning is automated and occurs instantaneously upon payment clearance. Therefore, the service is considered "started and deployed" immediately. No refunds are provided for server cancellations mid-cycle, nor for unused time on a subscription.
2.2 Custom Software and Web Designing
Once a contract is agreed upon and the initial payment is made, our engineering and design teams begin work. Because this involves non-recoverable labor hours, no refunds will be issued once the project is marked "in progress."
2.3 Third-Party Licenses (CPanel, DirectAdmin, etc.)
Software licenses are purchased from upstream providers on your behalf. These are non-refundable under any circumstances once issued.
3. Edge Cases and Clarifications
3.1 Hardware or Software Errors
If you experience a hardware failure (e.g., VPS node crash) or a software error related to our infrastructure, our obligation is to resolve the technical issue to restore service as per our Service Level Agreement (SLA). We do not issue cash refunds for downtime. Compensation for severe, prolonged downtime caused directly by Silkbinary (excluding Force Majeure or Third-Party faults) may be provided strictly as account credit at the sole discretion of management.
3.2 Subscription Overlaps and Accidental Renewals
It is the User's sole responsibility to manage their subscriptions via the client portal. If you forget to cancel a service and an automated renewal charge occurs via PayPal or PhonePe, the new cycle has "started." No refund will be issued for forgotten cancellations.
Hypothetical Scenario: Accidental Purchase
A User intends to buy a $10 Web Hosting plan but accidentally clicks and pays for a $100 Dedicated Server. The automated system instantly deploys the server, allocating IP addresses and booting the hardware. The User contacts support 5 minutes later requesting a refund.
Resolution: The refund is denied. The service was successfully deployed and resources consumed. The User may cancel the server to prevent future billing, but the initial payment is non-refundable.
3.3 Third-Party Service Interruptions
If a service degradation occurs due to a failure in our upstream providers (e.g., an AWS regional outage, a Cloudflare DNS issue, or a global CPanel bug), Silkbinary bears no liability. No refunds or account credits will be issued for downtime caused by Third-Party Services.
4. Dispute Resolution and Chargebacks
Initiating a chargeback or payment dispute via PayPal, your bank, or credit card provider constitutes a direct violation of these Terms. If a chargeback is filed, your Account and all associated Services (including websites, servers, and data) will be immediately and permanently suspended until the dispute is resolved in Silkbinary's favor, plus a $50 USD administrative fee.
